District Court

Do I need an attorney?

In Civil Small Claims cases and Informal Hearings on Traffic or Municipal Civil Infraction cases you cannot have an attorney. In all other matters the decision about hiring an attorney is up to you. If you cannot afford to hire an attorney in a Traffic or Criminal matter you may petition the court to appoint one. Whether or not the court will appoint one will depend on your financial status and/or whether the court determines in advance that jail is or is not an option should you be found guilty of the offense. If the court determines you can afford to hire your own attorney, or jail is not an option, an attorney will most likely NOT be appointed.
